On Thursday, 16 April 2015, the Administrative and Fiscal Litigation Division of the High Court of Cassation and Justice rejected a new second appeal filed by NHIH against a sentence of Bucharest Court of Appeals under which a claw-back notification issued based on GEO no. 104/2009 had been annulled.
This claw-back notification referred to a potential financial liability of almost RON 20 million for a company in the pharmaceutical industry. The court decision is final.
The representation of the company that obtained the final annulment of the claw-back notification was provided by lawyers of Bondoc si Asociatii SCA, who are involved in numerous similar cases against NHIH.
