HCCJ. Trespassing. Constitutive elements. Attempted crime of fraud

The High Court of Cassation and Justice has ruled that the act of entering, without right, in a building without the consent of the person who lives in tha building, represents the constitutive elements of the offense of trespassing, even if the person lives in the house without title and the offender brought an action in evacuation against him. In the case of attempted crime of fraud committed by requesting money to provide medical treatment for a minor that is deceased at the time of requesting these amounts, the information of harmed person regarding the death of the minor does not equivalent to an abandonment, while the offender has requested further amounts, by invoking another urgent case.
