In the Official Journal of the European Union, L 349 series, on 5 December 2014 was published the Directive 2014/104 / EU of the European Parliament and of the Council regarding certain rules governing actions for damages under national law in the case of legislation breaches in competition matters in the Member States and the European Union.
Object of the Directive: This Directive lays down certain rules necessary to ensure that any person who has suffered material damage caused by an infringement of law in competition matters by a company or association of companies can effectively exercise the right to request to that enterprise or associations of companies full compensation for the damage. This includes rules that promote undistorted competition in the internal market and remove obstacles to its proper functioning by providing equivalent protection throughout the Union for any person who has suffered such damage. The Directive lays down rules for the coordination of enforcing competition rules by authorities in competition matters and enforcement of those rules through the actions for damages before the national courts.
This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
