In the Official Gazette of Romania, Part I, no. 794 of 31st October 2014, the Law no. 145/2014 on establishing certain regulatory measures on the market of the products from agricultural sector has been published.
The Law regulates the method of performing economic activities, of capitalizing the agricultural products by the agricultural producers or natural persons, of exercising the trade with these products.
For that purpose, the following aspects are regulated:
– the procedure for obtaining the producer certification;
– the drafting, issuing and using regime of the commercialization report card of the products from agricultural sector;
– exercising the retail activities in public areas;
– contraventions and sanctions.
The commercialization of the products from the agricultural sector obtained from household/farm by the agricultural producers is based on the identity card, on the producer certification and on the record card of commercialization of the products from the agricultural sector.
The producer certification includes information and data regarding:
– name and surname of the agricultural producer;
– name of the products and the land area exploited, respectively the actual number of animals which are registered in the farm registry organized by the authorities of the local public administration within which radius the land/farm/household is placed.
The producer certification is issued, at request, to the natural persons who opt for performing an economic activity in the agricultural sector. The certification is issued by the mayor, with the advisory opinion of the professional associative/employer/trade union structures from agriculture.
According to law, the exercise of the wholesale trade and retail activities of the agricultural products obtained in the farm/household by the agricultural producers natural persons who hold an producer certification is made based on the commercialization record card of the products from the agricultural sector.
The selling of products bought from third persons based on commercialization record card is forbidden.
The commercialization record card of the products from the agricultural sector is issued, at request, to the applicant by the mayor of which competency radius the land/farm/household is placed, in which the products estimated to be commercialized are obtained, within 5 working days as of the date of request, after checking the existence of the producer certification and after the factual checking on the ground of the existence of the product/products subject to commercialization.
The commercialization record card form of the products from the agricultural sector has a special regime, is provided with safety elements and is printed, under the conditions of law, by the National Printing House, at the request of the county councils/ General Council of Bucharest, which distributes them to the mayors, at their request.
Within the structures of wholesale or retail commercialization, the organization of distinct sales areas, which are reserved exclusively to the agricultural producer natural persons who hold a producer certification and a commercialization record card for capitalizing the products from the agricultural sector, obtained from their household/farm.
