In the Official Gazette of Romania, part I, no. 251 of 30 April 2013 was published Government Emergency Ordinance no. 35/2013 for amending and supplementing Government Emergency Ordinance no. 34/2006 regarding the assign of procurement contracts, public works concessions contracts and services concession contracts.
The Emergency Ordinance adopts a number of measures in order to accelerate the procedures of procurement.
On this line, for increasing the efficiency of procurement processes, it inserts deadlines for each stage of the main procurement procedures which depends exclusively on the action and the will of contracting authority, as follows:
– In the procedure of open tender, the evaluation stage of bids will take place within a maximum 35 days from the opening of bids.
– In the procedure of restricted tender, selection of applicants will take place within 15 days from the deadline of applications.
– In the procedure of competitive dialogue, for candidates preselection it establishes a term of 15 days from the applications deadline, the dialogue with applicants will take place within a maximum of 120 days from the communicating date of invitation to dialogue, and the evaluation of bids will be held within a maximum 35 days from the opening of bids.
– In the procedure of negotiation with publication. The preselection of applicants will take place within 15 days from applications deadline, and the second stage of negotiation procedure within 50 days from the date of communicating the invitation to submit a tender.
