The Official Gazette of Romania, Part I, no. 738 of 1st of November 2012 has published Law no. 190/2012 on the responsibility of air traffic service provides.
The law regulates civil liability of air traffic service providers for damages produced to any third party in national airspace or the national territory, which occured as a result of actions or inactions of the air traffic service provider.
In order to cover civil liability for damages, the air traffic service provider is obliged to sign and retain throughout the provision of air traffic services, an insurance contract. The minimum sum assured is ecquivalent to 700 milion RON DST (special drawing rights, the accounting unit defined by the International Monetary Fund, used in for their transactions and operations) for each event that led to the occurance of damage.
The normative act establishes that the provision of air traffic in the national airspace without having a contract of insurance in force, is an offense which is punishable with a fine from 1,000,000 to 2,000,000 RON.
