The new civil procedure Code is very close

The vision of the Economist Intelligence Unit on the legal risks for business in Romania: The weekly report for the managers who lead the operations in Eastern Europe made by the Economist Intelligence Unit, The Economist group publication, refers, in the publication on 26 December 2011, among others, to Romania. Regarding the risks on the law and other regulations, the analysis of the prestigious international publication is made in the following terms: “The law provides an adequate protection for the property and for the contractual rights; including guarantees against expropriation but the enforcements institutions are weak.” * * * NNDKP – the first edition of a regional guide in terms of energy: As a co-founder member of the regional alliance SEE Legal, Nestor Nestor Diculescu Kingston Petersen (NNDKP) contributed to the first edition of SEE Energy Guide 2012, guide which covers the most important aspects on the energy sector of twelve jurisdictions in the region. The guide released this year includes legislation aspects treated on the experience accumulated by the law firms – members of SEE Legal, and information on the structure of  markets, conditions of licensing, regulations on prices. * * * The new civil procedure Code is very close: the 1st of June 2012: On a proposal from the Ministry of Justice, the Government approved, at the meeting on Wednesday, the 25th of January, the draft law for the implementation of the Law no. 134/2010 on the civil procedure Code. The time limit provided in the draft law for the implementation of the new civil procedure Code is the 1st of June 2012. By this draft law particularly complex is made the first step towards to a compatibility of legislation into force with the provisions of the new Code of civil procedure, making the inventory of the rules which will be repealed on the date of its entry into force, proposing the necessary amendments. * * * The companies should be assessed according to contribution to society: At the World Economic Forum in 2012, Deloitte Touche Tohmatsu Limited (DTTL) will present the results of a global study that analyzes the business leaders’ attitude on the purpose, the impact and the role of leader of business environment on the company. The study supported by DTTL and conducted by Economist Intelligence Unit (EIU), shows that over three quarters of responders (76%) believe that the value of a company should be measured by the positive contribution that its main field of activity has on the company, and depending on the profit made. However, 73% of responder leaders believe that the company’s main activity that they lead carries a positive contribution on the society. * * * New rules for making payments in advance of public funds: The Official Gazette of Romania, part I, no. 912 dated the 20th of December 2011 published the Government Decision no. 1231/2011 amending and supplementing the Government Decision no. 264/2003 establishing the actions and expenses categories, the criteria, the procedures and limits for making payments in advance of public funds. The changes cover issues such as: the beneficiaries of advances exempted from submission of guarantee’s instruments; the research-development programs and projects; the actions, the expenses’ categories, the criteria, the maximum procedures and limits on the granting of advances of public funds.
