The amending Regulation of the EU Directive regarding the application thresholds for the assigning procedure of public acquisitions contracts

In the Official Journal of the European Union, L 307, was published the Delegated Regulation (EU) 2015/2171 of the Amending Commision of Directive 2014/25/EU of the European Parliament and of the Council in respect of the application thresholds for the assigning procedure of public acquisition contracts.

The object of the Regulation: By Decision 94/800/EC, the Council concluded the Agreement on public acquisitions (hereby entitled “the Agreement”). The Agreement should be applied to any procurement contract with a value that reaches or exceeds the amounts (hereby entitled “thresholds”) set in the Agreement and expressed as special drawing rights. One of the objectives of Directive 2014/25/EU is to allow the contracting entities which apply that Directive to comply at the same time with the obligations laid down by the Agreement. To achieve this goal, the thresholds laid down by that Directive for the public acquisitions contracts which are also covered by the Agreement should be aligned in order to ensure that they correspond to the euro equivalents, rounded down to the nearest thousand, of the thresholds set out in the Agreement. For reasons of coherence, it is appropriate to align the thresholds set out by the Directive 2014/25/EU which are not covered by the Agreement. Directive 2014/25/EU should, therefore, be amended accordingly.

This Regulation enters into force on 1 January 2016.
