Aeroportul International Timisoara – Traian Vuia S.A. was successful for the second time, in court against the accusations brought by Carpatair S.A. concerning an alleged abuse of dominant position.

The attorneys of VILAU | ASSOCIATES, who assisted and represented Aeroportul International Timisoara – Traian Vuia S.A. all throughout the procedure at the Competition Council and the courts of law, brought solid arguments and once again refuted the ungrounded accusations of Carpatair S.A.

In 2014, the Competition Council decided to close the investigation initiated based on the complaint submitted by Carpatair S.A. against Aeroportul International Timisoara – Traian Vuia S.A. Carpatair S.A. filed an appeal against this decision.

On September 15, 2015, Bucharest Court of Appeal dismissed Carpatair’s claim based on the arguments presented by VILAU | ASSOCIATES and thus upheld the decision of the Competition Council.

The series of unsubstantiated accusations of Carpatair S.A. started in 2012, with the complaint submitted to the Competition Council regarding an investigation of the business of Aeroportul International Timisoara – Traian Vuia S.A, who, in Carpatair’s opinion, allegedly abused its dominant position. In addition, Carpatair S.A. asked for interim measures to be immediately taken against Aeroportul International Timisoara – Traian Vuia S.A.

In December 2012, based on the adequate defense prepared by the attorneys of Timisoara International Airport, the Competition Council decided there were no grounds to order any of the interim measures requested. An appeal against this dismissal decision was filed before Bucharest Court of Appeal, as Carpatair S.A. asked for the decision of the Competition Council to be cancelled and for interim measures to be ordered by the court.

However, Bucharest Court of Appeal agreed in 2013 with the arguments presented by the attorneys of Aeroportul International Timisoara – Traian Vuia S.A. and dismissed the motion filed by Carpatair S.A., upholding the decision of the Competition Council.
